Malaysians! Did you know it’s legal to have pets in condominiums?

For the longest time, Malaysian pet owners have resorted to various methods in keeping their beloved pets in condominiums. Whether it be hiding their pets from the management, hoping for pet friendly neighbors, putting in additional time to train their pets, or even moving to landed properties to avoid the consequences. However, with the new Strata Management Act amendments, substantial changes were made to the laws in Malaysia, in regards to keeping pets in apartments and condominiums.

According to By-Law 14 in the Third Schedule of the Strata Management (Maintenance & Management) Regulations 2015, residents of high-rise buildings are allowed to keep pets as long as their pets do not cause annoyance or a nuisance or pose health risks to other residents in the property. The amendments to the Strata Management act were enforced on 1st June 2015.

This being said, there are still certain matters that need to be considered. As mentioned before, pet ownership in condominiums is legal as long as they do not cause any nuisance or annoyances. Nuisance being any action or cause that may inconvenience the physical comfort of an individual, such as noise, while annoyance refers to any matter that causes protest to a reasonable mind.

Pet owners must also remember to take laws enforced by their local authorities and council into consideration and compliance. As an example, the Subang Jaya Municipal Council forbids the ownership of dogs within high-rises, while DBKL states that only smaller breeds of dogs are allowed in apartments and condominiums in Kuala Lumpur. Should the local council not have such by-laws, residents are not required to ask for the consent of their condominium or apartment management. This being said, if the condominium management refuses to abide by the current law, the pet owner has the right to file case at Strata Management tribunal.

Be sure to do your research on the regulations of your local council before adopting or purchasing your pet, so as to avoid any negative future consequences.
